The film tells the story of the “Central Park Jogger”, a woman who was found raped and assaulted in Central Park in 1989, and five young men who were arrested for the crime. Their convictions were vacated in 2002. The five men have filed a civil suit against the city of New York for $250 million, which still hasn’t been heard 10 years later. Authorities are demanding that Burns turn over footage, interviews and outtakes, but he refuses. This conversation took place before he was subpoenaed. he Central Park jogger case involved the assault and rape of a female jogger in New York City’s Central Park, on April 19, 1989. Five juvenile males—Antron McCray, Kevin Richardson, Raymond Santana, Yusef Salaam and Kharey Wise—were illegally tried and falsely convicted for the crime and served their sentences fully. The convictions were vacated in 2002 when Matias Reyes, a convicted rapist and murderer serving a life sentence for other crimes, confessed to committing the crime alone and DNA evidence confirmed his involvement in the rape.

We spend the hour with Ava DuVernay, whose damning new four-part television series “When They See Us” tells the story of five teenagers of color from Harlem—four African-American and one Latino—who were wrongfully accused and convicted of raping and nearly killing a white woman out for a jog in New York City’s Central Park. The night that would come to define the boys’ lives was April 19, 1989, more than 30 years ago. In the sensational trial that followed, they became known as the “Central Park Five.” Antron McCray, Kevin Richardson, Yusef Salaam and Raymond Santana served between six and seven years, and Korey Wise, the only teenager tried as an adult, served more than 13 years. In agonizing detail, “When They See Us” exposes the inner workings of a criminal justice system designed to fail people of color, laying bare the decades of trauma triggered by the boys’ wrongful convictions. It also looks unsparingly at those responsible for the miscarriage of justice, including Linda Fairstein, the head of the Sex Crimes Unit at the Manhattan District Attorney’s Office, who spearheaded the case, played by Felicity Huffman. Since the series premiered, Fairstein has been forced to resign from several boards, including Safe Horizon, the Joyful Heart Foundation and her alma mater, Vassar College. Glamour magazine, which named Fairstein Woman of the Year in 1993, issued a statement saying, “Unequivocally, Glamour would not bestow this honor on her today.” Ava DuVernay says that her series reveals that “the system’s not broken; the system was built this way.”

Yusef Salaam says their case is the story of the criminal system of injustice in America.

Subsequently a serial rapist and murderer Matiais Reyes operating in that area was caught and he admitted to raping that woman. It appeared the teenagers were innnocent. Post DNA…Why did they confess to a crime they didn’t commit. Disturbing and uncannily accurate confessions; and who is to blame?
Did the police hold and interrogate them long enough to deceive and trick them into confessing.
Were they merely parrots to police interrogators?

A miscarriage of justice primarily is the conviction and punishment of a person for a crime they did not commit. The term travesty of justice is sometimes used for a gross, deliberate miscarriage of justice. Miscarriage of justice” is sometimes synonymous with wrongful conviction, referring to a conviction reached in an unfair or disputed trial.

Causes of miscarriages of justice include:

Plea bargains that offer incentives for the innocent to plead guilty
Confirmation bias on the part of investigators
Withholding or destruction of evidence by police or prosecution
fabrication of evidence or outright perjury by police (see testilying), or prosecution witnesses (e.g. Dr Charles Smith)
Biased editing of evidence
Prejudice towards the class of people to which the defendant belongs
Poor identification by witnesses and/or victims
Overestimation/underestimation of the evidential value of expert testimony
Contaminated evidence
Faulty forensic tests
false confessions due to police pressure or psychological weakness
Misdirection of a jury by a judge during trial
perjured evidence by the real guilty party or their accomplices (frameup)
Perjured evidence by supposed victim or their accomplices
Conspiracy between court of appeal judges and prosecutors to uphold conviction of innocent

There is a system in place to ensure the fair treatment and justice for all citizens. We call it the Justice System, but is it really just? Growing up, it was my dream to become a lawyer in the United States, as I was a firm believer in fair treatment and an equitable world. As I grew older, I realized that law in the United States isn’t exactly evenhanded. This shouldn’t be the case. The Justice System and the laws that govern it are in serious need of reform.
Cassandra Owei is a Nigerian student at the American International School of Cape Town. Although Nigerian, she was born in Germany and brought up in South Africa. This global perspective has brought her in touch with many different cultures. Cassandra’s belief that all people should have basic rights and be treated equally led her to co-found the charitable company Caps For Care, a social enterprise that aims to help children in need. For her work with her company, she has been awarded the AISA Service and Leadership Award. Raymond Santana and Yusef Salaam, two members of the Central Park Five, who were wrongfully convicted of raping a jogger in the late 1980s, spoke with VladTV about their time in prison and later being found innocent.

Both Raymond and Yusef revealed they spent close to seven years in jail before Matias Reyes came forward and admitted to raping the woman. Reyes also confessed to several other heinous crimes, and his DNA was a match in the Central Park Five case.

Hit the above clip to hear more of what Raymond and Yusef had to say, including winning a case against New York for wrongful conviction and what it felt like to be found innocent.
